Terms of Service
These terms are written in English, and the English version applies.
Effective date: 2026-11-06
These Terms of Service ("Terms") are an agreement between you and My Ink QR ("we", "us", "our"), the operator of My Ink QR (the "Service"), a platform for creating and routing dynamic QR codes, landing pages, forms and unique codes. By creating an account, ticking the box to accept these Terms, or using the Service, you agree to them. If you use the Service for a company or other organisation, you confirm that you are authorised to accept these Terms on its behalf, and "you" includes that organisation.
1. Eligibility and accounts
- You must be at least 18 years old and able to enter into a binding contract.
- You must give accurate information and keep it up to date.
- You are responsible for everything done under your account, including by your team members, API keys and staff links. Keep your passwords, API keys and staff passwords secret, and turn on two-step verification. Tell us immediately at [email protected] if you suspect unauthorised use.
2. The Service
We provide software that routes scans of QR codes to destinations you choose, hosts landing pages and forms you create, and shows scan statistics. We may add, change or remove features, and set or change usage limits such as the number of QR codes, scans, API requests or storage. Free plan features and limits may change at any time.
3. Service provided "as is"
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that the Service will be uninterrupted, timely, secure or free from errors, vulnerabilities or data loss, that QR codes will scan on every device, or that scan statistics, location data or security checks will be complete or accurate.
4. Printed materials
You are responsible for test-scanning every QR code on several phones before printing it, and for keeping your account, plan and any custom domain active for as long as your printed QR codes are in use. QR codes may stop redirecting if your plan ends, your account is suspended or deleted, a custom domain stops pointing to the Service, or the Service is unavailable. We are not responsible for the cost of printing, reprinting, recalling or replacing any materials.
5. Your content and destinations
- You are solely responsible for the destinations, landing pages, files, text, images, forms and other content you add to the Service ("Your Content"), and for the websites your QR codes point to.
- We do not review Your Content before it goes live. We may, but are not obliged to, check destinations against security lists, show warning pages, pause QR codes or remove content at any time.
- You grant us a non-exclusive, worldwide, royalty-free licence to host, copy, display and transmit Your Content only as needed to run the Service.
6. Acceptable use
You must use the Service only for lawful purposes. You must not use it to:
- facilitate phishing, scams or fraud, or impersonate any person, brand or authority;
- distribute malware, or link to sites that do;
- host or link to illegal gambling, illegal drugs, counterfeit goods, child sexual abuse material, or content that infringes intellectual property or privacy rights;
- send unsolicited commercial communications, or collect personal data without a lawful basis;
- harass, threaten or defame anyone;
- interfere with the Service, probe or bypass its security, scrape it, overload it, or access it by automated means other than our published API;
- resell or sublicense the Service without our written permission, other than through our partner programme.
7. Security reviews, suspension and termination
We may investigate suspected violations, pause QR codes, show warning pages, limit features, or suspend or terminate your account immediately and without notice if we reasonably believe you have broken these Terms, if your use creates risk or harm for us, other users or the public, if the law requires it, or if a payment is overdue. Where the law requires or permits, we may report illegal activity and share relevant information with law enforcement or regulators. You may close your account at any time from the Account page.
8. Fees and payments
- Paid plans are charged in advance through our payment providers, such as Stripe and Billplz. Subscriptions renew automatically until you cancel them. One-time payments, such as FPX or e-wallet payments, cover the period shown at checkout and do not renew automatically.
- Except where the law requires otherwise, payments are non-refundable, including for partial periods and unused features.
- We may change prices with at least 30 days' notice. New prices apply from your next billing period.
- When a paid plan ends, paid features stop, and dynamic QR codes beyond the free limit stop redirecting after the grace period (14 days).
- Prices may be subject to applicable taxes.
9. API access
API access is given at our discretion and may be limited or withdrawn at any time. You must keep API keys secret, respect rate limits, and use the API only as described in our documentation.
10. Partners and white-label reports
If you are a partner, you are responsible for your clients' use of the Service, for what you tell them about it, and for getting any consent they need. Content you or your clients add is treated as Your Content under these Terms.
11. Unique codes, authenticity checks and lost-item tags
Authenticity checks, copy detection, coupons and tickets are tools to help you, not a guarantee. We do not guarantee that counterfeit products, copied codes or misuse will be detected or prevented, and we are not liable for losses from counterfeiting, fraud, or redeemed, copied or lost codes. Lost-pet and lost-item features depend on finders choosing to contact you or share their location, and we do not guarantee that any item or animal will be recovered.
12. Personal data and the PDPA
- For personal data you collect through the Service, such as form entries, contact details or event registrations, you decide why and how it is collected, and we process it on your behalf to provide the Service.
- You represent and warrant that you have a lawful basis and any consent required under the Personal Data Protection Act 2010 of Malaysia and other applicable laws, that you give people the notices the law requires, and that you handle their requests to access, correct or delete their data.
- We process personal data as described in our Privacy Policy and take reasonable security measures, but no system is completely secure. We are not responsible for your own data management practices.
13. Third-party services
The Service relies on third parties for hosting, networking, payments, email, messaging and security lists. We are not responsible for their acts, failures, outages or changes, or for websites and content that QR codes link to.
14. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, business, goodwill or data, or the cost of printing or replacing materials, even if we were told such loss was possible. Our total liability for all claims relating to the Service is limited to the amount you paid us for the Service in the one month before the event that gave rise to the claim. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited by law, including any rights you have under the Consumer Protection Act 1999 where it applies.
15. Indemnity
You agree to defend, indemnify and hold harmless us and our owners, employees and agents from any claims, damages, losses, fines, costs and expenses, including reasonable legal fees, arising from Your Content, your QR codes and their destinations, your use of the Service, your breach of these Terms, or your violation of any law or anyone's rights.
16. Events beyond our control
We are not responsible for delays or failures caused by events beyond our reasonable control, including power or internet outages, failures of third-party providers, cyberattacks, natural disasters, epidemics, government action or labour disputes.
17. Data retention and backups
We keep scan statistics for the periods described in our Privacy Policy. When you delete your account, we delete your data from the live system, and copies may remain in encrypted backups for up to 30 days. Payment records and the other records described in section 25 may be kept longer where the law requires or allows. Export anything you need before closing your account.
18. Changes to these Terms
We may update these Terms. When we make a material change, we will tell you by email or on the Service, and ask you to accept the new version before you continue to use your account. If you keep using the Service after the effective date, you also accept the changes.
19. Governing law and disputes
These Terms are governed by the laws of Malaysia. Before starting legal proceedings, both sides agree to try in good faith to resolve the dispute for at least 30 days after one side notifies the other in writing. The courts of Malaysia have exclusive jurisdiction.
20. General
- You agree that accepting these Terms electronically, such as by ticking a box, is as binding as a signed agreement.
- If any part of these Terms is found unenforceable, the rest remains in effect.
- These Terms, our Privacy Policy and the terms shown at checkout are the entire agreement between us about the Service.
- We may transfer these Terms as part of a sale, merger or restructuring. You may not transfer them without our written consent.
- If we do not enforce a provision, that is not a waiver of our right to do so later.
- If these Terms are translated, the English version prevails.
21. Staff, team members and API keys
You may give staff members, team members, partners' clients or API keys access to your account. Everything they do, including redeeming coupons, checking in tickets, adding stamps, editing destinations and deleting data, counts as your action. You must give each person their own login, keep passwords secret, and remove access as soon as someone no longer needs it.
22. Short links and sharing
The links behind your QR codes can also be shared as short links. These Terms apply to them in the same way. You must not use short links to hide where a link goes in order to deceive people, to send spam, or to get around another platform's rules. We may show a warning page before a short link opens, or disable it, at any time.
23. Multi-language content
You are responsible for the accuracy and legality of every language version of your content, including translations you or anyone else writes. If versions differ, you are responsible for any confusion or loss this causes.
24. Business details and receipts
Any company details you add, such as your company name and SSM registration number, must be accurate and belong to you. Payment confirmation emails confirm that we received payment. They are not tax invoices or e-invoices unless we say so in writing. You are responsible for your own taxes and accounting.
25. Records and evidence
We keep records such as acceptances of these Terms, login and security logs, IP addresses, changes to destinations, staff actions and payment records. We use them to protect the Service, meet legal obligations and resolve disputes, and we may keep them after your account is closed for as long as the law requires or allows. You agree that these records may be used as evidence of what happened on your account.
26. Account security
We may email you when your account logs in from a new network. You are responsible for securing your devices, email account and passwords. To the extent permitted by law, we are not liable for loss caused by someone using your password, API key, staff password or session, unless it was caused by our own breach of these Terms.
27. Plans, limits and promotion codes
- Each plan has the limits and features shown on our pricing page. Limits apply to creating new items. Codes you already use keep redirecting while your plan covers them.
- If you downgrade, cancel or do not renew, items over your new plan's limits, or using features it does not include, stop after the grace period (14 days). You may choose which codes to keep. Paying again restores them.
- Monthly allowances, such as form entries and unique codes, reset on the 1st of each month (Malaysia time) and do not carry over.
- Promotion codes give free time on a paid plan. They have no cash value, cannot be exchanged or transferred, are limited to one per account, and may be withdrawn or reversed if obtained or used in breach of these Terms or by mistake. When the free time ends, your account moves to the Free plan unless you pay.
- Add-ons are optional extras for an active plan. Monthly add-ons end when the plan ends.
- Referral commissions, where offered, follow the statement we send and are paid only on payments we actually receive.
